1. Contract Structure and Governing Law
These Terms of Service govern the access, browsing, and purchase of goods from Buudy through our online storefront (ca.buudy.com) and payment infrastructure hosted on Whop. The commercial contract is formed in the English language and governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of the Province of Ontario retain non-exclusive jurisdiction over any disputes arising under this agreement. By completing a purchase, you agree to these Terms, the Shipping Policy, and the Return, Refund, and Cancellation Policy.

In compliance with Canadian commercial disclosure standards and e-commerce best practices, our trading details are:

3. Orders, Pricing, and Formation
Order submissions through the Whop checkout represent a binding offer to buy. Legal contract formation occurs upon parcel dispatch and the issuance of a Dispatch Confirmation containing carrier tracking data.
Displayed prices are in Canadian Dollars (CAD / CA$), inclusive of applicable Canadian GST/HST and import clearance under Delivered Duty Paid (DDP) terms. We reserve the right to cancel orders arising from clerical, server, or typographical pricing errors prior to dispatch.
4. Product Intended Use and Non-Medical Disclaimer
The Buudy LED Face Mask and Buudy LED Torch are personal cosmetic wellness appliances designed solely to support aesthetic skin appearance, smoothness, and tone.
Explicit Non-Medical Disclaimer: The products sold by Buudy are not medical devices as defined under the Health Canada Medical Devices Regulations. They are not engineered, licensed, or intended to diagnose, treat, prevent, or cure any dermatological pathology, illness, clinical acne, or medical disorder. The Skincare Quiz, mobile companion tools, and website content provide general cosmetic guidance, not professional healthcare or medical advice. Consult a licensed medical practitioner before using light therapy if you are pregnant, experience photosensitive epilepsy, or take light-sensitizing medication.
5. Limitation of Liability
To the maximum extent permitted under Canadian law, Buudy's aggregate commercial liability relating to any order shall not exceed the total purchase price paid for the product. Nothing in these Terms shall limit or exclude liability for gross negligence, intentional misconduct, fraudulent misrepresentation, or any statutory consumer right protected under Canadian provincial consumer protection legislation that cannot be waived by contract.
6. Dispute Resolution and Chargeback Abuse
Customers agree to submit billing, delivery, or product disputes to support@buudy.co.uk or open an inquiry in the Whop Resolution Center prior to approaching their payment card issuer. Both parties commit to an amicable resolution window of seven (7) business days before initiating payment claims.
Submitting a payment dispute claiming non-delivery after verifiable carrier tracking establishes successful doorstep delivery, or claiming a refund while retaining unsealed, used hardware, constitutes an abusive dispute. In such events, Buudy reserves the right to provide transaction logs, IP history, signed proof of delivery, and signed terms to card schemes and recovery agencies.
7. Mandatory Consumer Rights
Mandatory consumer rights under Canadian provincial and federal legislation remain applicable. If any term in this agreement conflicts with a statutory right that cannot legally be waived, the mandatory Canadian statutory provision will prevail.
8. Intellectual Property & Permitted Use
All storefront software, branding, imagery, visual design, and written content belong to Buudy and its licensors. Content is provided solely for personal, non-commercial shopping purposes.
